Justice Antonin Scalia’s death could change the course of history on the contentious social and legal issues pending before the Supreme Court this term, especially in closely divided cases where he was expected to serve as a lynchpin of a conservative majority.

In cases where the eight remaining justices are evenly divided, appeals court rulings would be left to stand, but no precedent would be set for future cases. The justices could also hold cases and leave stays of lower court rulings in place, while awaiting confirmation of a new justice, but it’s unclear if they would do so for nearly a year if the Senate refuses to consider any nominee while President Barack Obama is in office.

ART: Dead Michael Brown lies on floor of Chicago gallery in ‘white privilege’ exhibit

An exhibit that the artist says contains “images of white privilege in America” and “how it negatively affects the black community” has opened in Chicago.

It contains provocative caricatures of Christ on the cross with a bag over his head and the message “I can’t breathe,” multiple perversions of the American flag and cell bars made of money rolls with black faces behind them.

Included, too, are messages about “white privilege” across a backdrop of saltine cracker boxes, a black Statue of Liberty and a noose hanging from a neon sign that says “nickle ride.”

But perhaps the most provocative: a body lying on the floor representing Michael Brown–the Ferguson, Missouri teen killed last year after a scuffle with a police officer.

WGN calls them “thought-provoking images.”

Washington (CNN) Rick Perry on Thursday said the Republican Party lost some of its "moral legitimacy" by not vying for the black vote in past elections, adding that the GOP has "much to do" to earn the trust of African-Americans.

Perry, the former Texas governor and 2016 presidential hopeful, used a half-hour speech at the National Press Club in Washington to try and recast blacks' concerns as going beyond race, pitching his much-touted jobs record in Austin as the most enticing message to woo skeptical black voters.

Texas Woman Discovers She's White After 70 Years

 CONVERSE, Texas — A well-kept family secret about racial identity has given a Texas woman a unique perspective on the uproar surrounding Rachel Dolezal.

The mere mention of Dolezal's name sets Verda Byrd off like a stick of dynamite.

"She lied about her race," Byrd said. "I didn't lie because I didn't know."

Dolezal's publicized choice to identify herself as black has been under scrutiny. The former NAACP president in Spokane, Wash., is accused of deceiving the public by insisting she was not only of black descent but black herself.

Byrd considers herself African American.

"I'm comfortable with being a black woman," she said.

Her preference in race comes through an incredible set of circumstances. Byrd was born to Earl and Daisy Beagle in September 1942. Her biological parents, whom she describes as white transients, named her Jeanette.

Her father walked out on his family leaving her mother with 10 children to care for. After Daisy Beagle fell 30 feet to the ground in a trolley accident, the state of Missouri took her children away from her because she could not care for them.

Poll: 40% Think Police Make Unfair Judgments About Race

A new poll of more than 2,000 registered voters finds sizable segments of the population — across racial, political and generational lines — believe the police "routinely" make unfair judgments about people based on race/ethnicity, that race relations are as tense now as they were during the Civil Rights era, and that racism remains a major problem.

The survey, commissioned by Rare.us, polled a random group of 2,261 voters in the United States regarding current political and social issues.

It found sharp differences of opinion along racial and party lines, but not as much between younger and older Americans.

About 41 percent of all respondents said they believe police officers "routinely make unfair judgments about people based on race or ethnicity." About 55 percent said they trust the police to "do the right thing."

Conservative candidate Mia Love made history on Tuesday by becoming the first black female Republican elected to Congress. While it’s a major milestone, Love hit back against suggestions that her election victory was the result of her race or gender during a Wednesday CNN appearance.

CNN host John Berman asked Love a seemingly back-handed question aimed at Republicans regarding why it took so long for the party to elect a black woman. Love was clear that her campaign and victory had “nothing to do with race.”

The Obama administration quietly has been forcing new gun buyers to declare their race and ethnicity, a policy change that critics say provides little law enforcement value while creating the risk of privacy intrusions and racial profiling.

With little fanfare, the Bureau of Alcohol, Tobacco, Firearms and Explosives (ATF) in 2012 amended its Form 4473 — the transactional record the government requires gun purchasers and sellers to fill out when buying a firearm — to identify buyers as either Hispanic, Latino or not. Then a buyer must check his or her race: Indian, Asian, black, Pacific Islander or white.

The amendment is causing a headache for gun retailers, as each box needs to be checked off or else it’s an ATF violation — severe enough for the government to shut a business down. Many times people skip over the Hispanic/Latino box and only check their race, or vice versa — both of which are federal errors that can be held against the dealer.

Requiring the race and ethnic information of gun buyers is not required by federal law and provides little law enforcement value, legal experts say. And gun industry officials worry about how the information is being used and whether it constitutes an unnecessary intrusion on privacy.

“This issue concerns me deeply because, first, it’s offensive, and, secondly, there’s no need for it,” said Evan Nappen, a private practice firearms lawyer in New Jersey. “If there’s no need for an amendment, then there’s usually a political reason for the change. What this indicates is it was done for political reasons, not law enforcement reasons.”
