Why Background Checks Couldn’t Stop Dylan Roof

The FBI says that the federal background check system for guns should have stopped Dylann Roof, the racist who killed nine black parishioners at a church in Charleston.

“This rips all of our hearts out,” says FBI Director James Comey, who blamed the mistake at least partially on improperly labeled paperwork.

But the truth is more complicated. First, even a perfectly functioning background check system very likely wouldn’t have stopped Roof from getting a gun. Second, the current background check system is a much worse mess than Comey recognizes.

With Roof planning his attack for at least six months, it seems hard to believe that he couldn’t have figured out some way of obtaining a gun. Indeed, he stole the gun that he used in this attack.

Why Walmart Will Keep Selling Guns

(CNN)Confederate flags are off the shelves at Walmart. But still up for grabs: guns.

Walmart, the nation's largest retailer, was the first to announce plans this week to remove Confederate flag products from its stores after Dylann Roof killed nine African-Americans in a Charleston, South Carolina church. The company was hailed by many for quickly responding to the uproar over the flag. But it has since come under pressure to also stop selling guns in response to the nation's latest mass shooting.

"I would hope that stores like Walmart would recognize the danger of having these guns displayed right next to an aisle away from microwave popcorn and and Xbox games," said U.S. Sen. Chris Murphy, a Connecticut Democrat who has pressed for gun control since 20 children were shot and killed at a school in his state in 2012. "I'm not terribly confident that a 21-year-old Walmart clerk is going to sell guns responsibly or be able to give customers the kind of advice they need on how to responsibly use that gun."

The debate over the Confederate flag has also raised broader questions about where the line should be drawn for retailers that sell other questionable or offensive products.

Domestic Violence Offenders Giving Up Guns In Texas

(NBC News) -- Since the first week of May, a sheriff's deputy stationed inside Dallas' DFW Gun Range has had a unique assignment: confiscate and catalog guns given up by domestic violence offenders.

It's the first time in Texas that government is teaming up with a private gun range to collect firearms from convicted batterers in Dallas County — and advocates hope it's an approach that can serve as a role model nationwide.

Dallas, where domestic homicides have been on the rise in recent years, is a prime place to start. Domestic violence has gotten so out of hand in Texas' third-largest city that Mayor Mike Rawlings previously told NBC News the crime is "the biggest act of terrorism," shrouded behind closed doors and spoken of in hushed tones.

The push to allow the concealed carry of firearms on college campuses is underway in the Indiana General Assembly.

“The biggest reason is because of the vulnerability of college campuses in general,” Vining said. “There’s a very good reason you don’t hear about mass shootings taking place in gun shops or gun shows.”

There are already laws that 
allow for the concealed carry of weapons on college campuses in seven states, including Colorado, Idaho, Kansas, Mississippi, Oregon, Utah and Wisconsin.

Well, it's been nearly a year now since Illinois State Police started issuing permits to citizens who met the established criteria. The result? Local authorities say concealed carry in Illinois has been a non-event — in other words, no problem.

The apocalyptic rhetoric and doomsday predictions have turned out to be so much hot air. So also have predictions that anywhere from 300,000 to 400,000 Illinoisans would apply for a permit and start packing heat. So far, the number is around 90,000. The number will grow, but it's a long way to 300,000 concealed carry licenses.

A Texas motorist who’s also a concealed handgun license holder told police he saw a man beating a woman in another car on Friday afternoon, the Fort Worth Star-Telegram reported.

So he got out of his car when both vehicles had stopped, pointed his gun at the other driver and forced him out of the vehicle until Southlake police arrived, the Star-Telegram reported.

Support For Gun Rights At Highest Point In Two Decades

Support for gun rights is higher than it’s been in decades, according to the latest data from the Pew Research Center that signals a stunning turnaround in how Americans feel about the issue just two years after the Newtown school shooting.

Pew found that 52 percent of Americans say Second Amendment rights are more important than gun control — up 7 percentage points from just after the December 2012 Sandy Hook Elementary School shooting that left 20 schoolchildren and six faculty dead.

That’s the highest approval rating in two decades, and it’s being driven in part by changing attitudes among black Americans, who are increasingly likely to view guns as good for public safety.

Pew found 54 percent of blacks now say firearms protect people from being victims of crimes, compared to 41 percent who say they are a public safety risk. Just two years ago, only 29 percent of blacks said guns were a public safety boon.

“Over the past two years, blacks’ views on this measure have changed dramatically,” Pew researchers said.

The Obama administration quietly has been forcing new gun buyers to declare their race and ethnicity, a policy change that critics say provides little law enforcement value while creating the risk of privacy intrusions and racial profiling.

With little fanfare, the Bureau of Alcohol, Tobacco, Firearms and Explosives (ATF) in 2012 amended its Form 4473 — the transactional record the government requires gun purchasers and sellers to fill out when buying a firearm — to identify buyers as either Hispanic, Latino or not. Then a buyer must check his or her race: Indian, Asian, black, Pacific Islander or white.

The amendment is causing a headache for gun retailers, as each box needs to be checked off or else it’s an ATF violation — severe enough for the government to shut a business down. Many times people skip over the Hispanic/Latino box and only check their race, or vice versa — both of which are federal errors that can be held against the dealer.

Requiring the race and ethnic information of gun buyers is not required by federal law and provides little law enforcement value, legal experts say. And gun industry officials worry about how the information is being used and whether it constitutes an unnecessary intrusion on privacy.

“This issue concerns me deeply because, first, it’s offensive, and, secondly, there’s no need for it,” said Evan Nappen, a private practice firearms lawyer in New Jersey. “If there’s no need for an amendment, then there’s usually a political reason for the change. What this indicates is it was done for political reasons, not law enforcement reasons.”

Politifact: Have There Been 74 School Shootings Since Sandy Hook? --No, "mostly false"

After an Oregon high school freshman armed with an assault rifle injured a teacher, killed a student and killed himself Tuesday, a striking statistic began circulating on the internet. It said that at least 74 school shootings had occurred since December 2012, when an assault on Sandy Hook Elementary School by Adam Lanza left 28 dead, including Lanza and his mother.

The statistic came from Everytown for Gun Safety, an advocacy group founded by former New York City Mayor Michael Bloomberg and gun-control advocate Shannon Watts. That comes out to more than one school shooting per week.

Numerous media outlets reported the 74 school shootings figure, and the number spread widely in Facebook posts and through other forms of social media. Even President Barack Obama brought up the once-a-week line in an interview with Tumblr CEO David Karp.

In the interview, Obama discussed his frustration with lawmakers’ inaction on gun control legislation, particularly in the wake of Sandy Hook. While it’s not clear that Obama was specifically referencing the statistic compiled by Everytown, his comment was in line with their math. "We’re the only developed country on Earth where this happens," he said,
"and it happens now once a week."

But as widely as the number spread, it also attracted criticism. Charles Johnson, who writes for the conservative Daily Caller, garnered attention for what he considered a debunking of the Everytown list.

We decided to sift through the numbers ourselves.

Sonic, Chili's Say No Guns Inside --Sure you want to do that?

Sonic Drive-In and Chili's Grill & Bar have added their corporate voices to a growing list of food firms asking patrons to enjoy their meals without their guns.

The announcements Friday follow recent demonstrations by open-carry activists who brought rifles and shotguns into Sonic, Chili's and Chipotle Mexican Grill outlets in Texas.

STORY: Chipotle asks customers not to bring guns to its stores

"We recognize that the open carry of firearms in restaurants creates an uncomfortable atmosphere and is not permitted under many local liquor laws," said a statement from Brinker International, Chili's Dallas-based parent. "So, we kindly ask that guests refrain from openly carrying firearms into our restaurants and we will continue to follow state and local laws on this issue."

Texas law prohibits rifles and shotguns where alcohol is served.

In its statement, Sonic said that although the company has historically relied on local laws "to guide how we address the display of guns at drive-ins, recent actions required we carefully reconsider this approach."

"We've considered the views and desires of our customers and employees that staff the drive-ins across the country," the Oklahoma City-based company said. "Accordingly, we're asking that customers refrain from bringing guns onto our patios or into our indoor dining areas. With respect to the storage of guns in vehicles, we ask that our customers continue to honor local laws."

Moms Demand Action for Gun Sense in America had lobbied Chipotle, Chili's and Sonic to ban open carrying of guns in their restaurants.

"Moms thank Sonic and Brinker International, which includes Chili's Grill & Bar, for taking action to stand up for the safety and security of our families," founder Shannon Watts said Friday. "We are heartened that we can take our children to these family-oriented restaurants and not worry about being confronted by customers with semiautomatic rifles."

After the open-carry demonstration two weekends ago by Open Carry Texas, Denver-based Chipotle asked customers to not bring guns inside. The gun-rights group did not immediately respond to a USA TODAY request for comment.

Starbucks, Wendy's, Jack In The Box, and Applebees have instituted similar no-guns policies.

Democrats Using CA Shooting To Pass Gun Bans That Already Exist --Can't be too sure

On May 30 Breitbart News reported that Representative Mike Thompson (D-CA) and about two dozen Democrats are pushing a bill ostensibly aimed at banning stalkers, domestic abusers, and the mentally defunct from buying guns.

The problem with these bans is that they already exist via ATF Form 4473--a federal form gun purchasers submit to when going through a NCIS background check.

Here are three questions from that form:

Question 11f, form 4473: "Have you ever been adjudicated mentally defective (which includes a determination by a court, board, commission, or other lawful authority that you are a danger to yourself or to others or are incompetent to manage your own affairs) OR have you ever been committed to a mental institution?"

Question 11h, form 4473: "Are you subject to a court order restraining you from harassing, stalking, or threatening your child or intimate partner or child of such partner?"

Question 11i, form 4473: "Have you ever been convicted in any court of a misdemeanor crime of domestic violence?"

If your answer is "yes" to any of these questions, then an individual is already barred from buying a gun.

So if the stalkers, domestic abusers, and the mentally defunct are already barred from buying a gun, why are Democrats pushing legislation to bar them from buying a gun?

SANTA BARBARA, Calif. — With the toughest gun-control regulations in the country, California has a unique, centralized database of gun purchases that law enforcement can easily search. It offers precious intelligence about a suspect or other people officers may encounter when responding to a call.

But this rare advantage wasn’t enough to help authorities head off the May 23 rampage in Santa Barbara that claimed six victims.

Before a half-dozen sheriff’s deputies knocked on Elliot Rodger’s door last month in response to concerns raised by his mother about his well-being, they could have checked the database and discovered he had bought three 9mm semiautomatic handguns. Several law enforcement officials and legal experts on gun policy said this might have given deputies greater insight into Rodger’s intentions and his capability for doing harm.

The deputies did not check the database. They left his apartment after finding him to be “shy, timid, polite and well-spoken,” in the words of Santa Barbara County Sheriff Bill Brown. The deputies saw no evidence that Rodger was an immediate threat to others or to himself.

“I cringed when I learned they didn’t run for guns,” said Emeryville Police Chief Ken James, who is chairman of the California Police Chiefs Association’s firearms committee.

James said law enforcement officials are not required to check the Dealer’s Record of Sale (DROS) database before going to the home of someone who is potentially suicidal. But after the killings in Santa Barbara, he said he expects it will become more common.

North Carolina restaurant The Pit was robbed at gunpoint on Sunday. Normally, local crime stories like this wouldn't merit a Townhall post, but this one is different: The Pit has a "no weapons" sign displayed prominently on its door declaring the restaurant a gun-free zone, and bans patrons from carrying concealed weapons.

Authorities said just before 9 p.m. Sunday, three men wearing hoodies entered the restaurant through the back doors with pistols, and forced several staff members to lie on the floor.

The bandits assaulted two employees during the crime, but they were not seriously injured.

What groups like Everytown for Gun Safety or Moms Demand Action for Gun Sense in America seem to have an issue grasping is that criminals have no respect for the law by nature of being criminals. Criminals aren't going to be stopped by a "no guns allowed" sign. If somebody is going to rob or shoot up a Chipotle, for instance, they're not going to care that they cannot (or have been politely asked not to) bring a gun onto the premises. Criminals are not going to submit to background checks. They'll use straw purchases or just buy a gun from an illegal source. All these policies and laws do is make it harder for legal gun owners to protect themselves.

While I am thankful nobody was hurt, this certainly harms the narrative that "gun free" places are safe places.

Chipotle is asking customers not to bring firearms into its stores after it says gun rights advocates brought military-style assault rifles into one of its restaurants in Texas.

The Denver-based company notes that it has traditionally complied with local laws regarding open and concealed firearms.

But in a statement Monday, the company said that "the display of firearms in our restaurants has now created an environment that is potentially intimidating or uncomfortable for many of our customers."

The announcement came after a petition by Moms Demand Action for Gun Sense in America, which has called on other companies to ban firearms in their stores as well. The group said its petition was in reaction to open-carry gun activists appearing at a Dallas-area Chipotle restaurant over the weekend.

Erika Soto Lamb, a spokeswoman for the group, said she thought the move by Chipotle was a "bold statement," especially considering its previous stance of complying with local laws.

Many states allow people to carry licensed guns in some way, but some businesses exercise their right to ban firearms.

A Chipotle spokesman didn't immediately respond when asked if the company's request was an outright ban, or how it would respond if people continued to bring firearms into its restaurants.

Last year, Starbucks Corp. also told customers that guns were no longer welcome in its cafes after it had to temporarily close a store in Newtown, Connecticut, to avoid a demonstration by gun rights advocates. The company said it shut down the store out of respect for the community, where 20 school children and six educators had been slain.
