SCOTUS Obamacare Ruling: 2016 Presidential Candidates, Other Politicians Weigh In

The U.S. Supreme Court on Thursday upheld the provision of tax subsidies under the 2010 Affordable Care Act, President Barack Obama’s signature health care law.

It was the second time in three years the nation’s highest court has handed the Obama administration a key victory in its fight to defend the law, which has been under unremitting attack from conservatives since its passage.

“The Affordable Care Act is here to stay,” Obama said in a statement from the White House Rose Garden after the court ruling. “This is a good day for America.”

Shortly after the court’s decision was handed down, those hailing the ruling — and hating on it — lit up Twitter.

MSNBC: John Roberts 'Has Become Most Pivotal Legal Defender Of Affordable Care Act'

MSNBC host and legal analyst Ari Melber called Chief Justice John Roberts the "most pivotal legal defender" of President Obama's healthcare law after it was announced the Supreme Court voted to uphold Obamacare subsidies.

ARI MELBER, MSNBC: He has become the most pivotal legal defender of the Affordable Care Act. And, again, this is what's so interesting about the Court, especially not only for Court junkies like us but for people around the country. The fact that you might think from Justice Roberts' history and from the president that appointed him, he might be skeptical of Obamacare. That may or may not be true.

The Chief Justice saying today, that does not matter, that's not what moved him in this case. What moved him was the simple question, what was this law supposed to do, fund health care or defund it? Was it supposed to fund it nationally or only in certain states? He says it's clear to him that as drafted by the Democratic majority in Congress and signed by President Obama, it was clearly dined to fund and advance health care, not yank it away.

Forbes: What? President Obama Thinks Obamacare Working 'Better Than Intended'?

President Obama’s reaction to yesterday House vote to repeal Obamacare was astonishing. “This is working not just as intended, but better than intended” he declared at a White House meeting with 10 people purported to have benefited from the law. Call me gob-smacked. President Obama either has an exceedingly poor memory or is (yet again) engaging in some serious truth-twisting regarding Obamacare. As we’ll see, President Obama has earned an F on the five biggest promises he made about his law. Moreover, relative to CBO projections, Obamacare has achieved at worst 50% of what was expected or at best 88%. If the president reallyintended for his law to achieve such dismal results, he should have told us that five years ago.

What Was Promised For Obamacare?

Let’s start with the five most significant promises made by the president regarding Obamacare:

Promise #1: Universal Coverage. Candidate Obama promised on June 23, 2007: “I will sign a universal health care bill into law by the end of my first term as president that will cover every American.” Let’s give the president the benefit of the doubt and assume that by “Americans” he was excluding the 5.6 million illegal immigrants who are uninsured since Obamacare by design will not cover them.

Cost Still A Barrier Between Americans And Medical Care

Since 2001, Gallup has asked Americans each November if they have put off any sort of medical treatment for themselves or their families in the past 12 months. Last year, many hoped that the opening of the government healthcare exchanges and the resulting increase in the number of Americans with health insurance would enable more people to seek medical treatment. But, despite a drop in the uninsured rate, a slightly higher percentage of Americans than in previous years report having put off medical treatment, suggesting that the Affordable Care Act has not immediately affected this measure.

House GOP File Lawsuit Against Obama

House Republicans on Friday filed a long-awaited lawsuit accusing President Barack Obama of overstepping his executive authority when implementing his signature health care law.

And though the suit is centered on the Affordable Care Act, the GOP moved on the legal action the morning after the president announced he will unilaterally grant temporary relief to millions of undocumented immigrants.

"Time after time, the president has chosen to ignore the will of the American people and re-write federal law on his own without a vote of Congress. That's not the way our system of government was designed to work,” House Speaker John Boehner said in a statement. “If this president can get away with making his own laws, future presidents will have the ability to as well. The House has an obligation to stand up for the Constitution, and that is exactly why we are pursuing this course of action."

The suit, filed against the heads of Health and Human Services and Treasury Department, is centered on the White House decision to delay the employer mandate of the health care law and accuses the administration of unlawfully giving $175 billion to insurance companies.

House Republicans approved a bill authorizing the legal action in a 225-201 vote in July. No Democrats supported the measure.

In the 2011 video shot by TrueNorthReports.com and released on Thursday, Gruber appears before the Vermont House Health Care Committee to present recommendations for a universal, publicly financed health care program.

Gallup: 'New Numerical Low' For Obamacare

Just 37 percent approve of the Affordable Care Act, 1 percentage point less than the previous low recorded in January, Gallup found in a new survey released Monday.

The pollster notes the approval results are a “new numerical low” for Obamacare.

The second enrollment season kicked off on Saturday, with minor snags; however, enthusiasm for the law remains underwhelming. A majority of Americans disapprove of Obamacare, at 56 percent — a new high, Gallup said.

Mother Jones On SCOTUS: OCare Case 'Turns On A Typo'

On Friday, the Supreme Court announced that it would hear King v. Burwell, a case that could gut Obamacare and leave millions of Americans without health insurance. The case hinges on what is essentially a typo in the Affordable Care Act, a mistake that conservatives claim invalidates most of the subsidies the bill provides to help people buy insurance. If the justices buy the conservatives' argument—and there's reason to think they might—residents of the 34 states that provide health insurance via the federal government's HealthCare.gov, rather than through a state-run exchange, could lose their subsidies. Many people would be unable to afford to buy insurance (as the ACA requires), and the whole system could collapse.

Here's the good news: There may be a workaround. But there's also bad news: The solution requires the cooperation of Republican governors and legislators.

As President Obama addresses a Joint Session of Congress on his health care proposals - the proposals that would eventually become The Patient Protection and Affordable Care Act (ACA) -- aka ObamaCare -- South Carolina Congressman Joe Wilson abruptly and famously shouted “You lie!” While Wilson was chastised for his decided breach of congressional decorum, in fact what he was literally yelling about were these words from President Obama: “There are also those who claim that our reform effort will insure illegal immigrants. During a discussion on MSNBC’s The Cycle about the disparaging comments ObamaCare architect Jonathan Gruber made about the law’s passage and the “stupidity” of voters, New York Times writer and substitute Cycle co-host Josh Barro sought to defend him by blasting the expectations that Americans have about health care as “completely incoherent” and lying was the only solution to make them happy.

Barro told fellow panelists and guest Lauren Fox of National Journal that “what drives me crazy about this story” was that: “Jonathan Gruber was right. Public opinion on health care policy is just completely incoherent.”

GOP’s Anti-Obamacare Push Gains New Momentum In Wake Of Gruber Video

The Republican Party’s ardent campaign against President Obama’s health-care law gained new momentum Wednesday as lawmakers reacted angrily to assertions by an architect of the policy that it was crafted in a deliberately deceptive way in order to pass Congress.

On both sides of the Capitol, leading conservatives said they may call economist Jonathan Gruber to testify about his remarks, which were made last year and surfaced this week in a video on social media. In the video, Gruber suggests that the administration’s signature health-care legislation passed in part because of the “stupidity of the American voter” and a “lack of transparency” over its funding mechanisms.

Obama Officials Work On Health Site Contingency Plans, Enrollment Nears

As the Nov. 15 beginning of open enrollment nears, administration officials have been eager to draw public attention to the fact that parts of the computer system have been rebuilt, online insurance applications will be easier to use and new federal managers are in charge.

“We’re really making sure that that Web site works super well,” President Obama said at a news conference a few days ago. “We’re double- and triple-checking it.”

Despite such efforts, the confidential documents written in recent weeks hint at elaborate backup planning that undercuts the administration’s predictions that an improved HealthCare.gov will be able to handle everyone who wants to sign up. More broadly, they reflect the high stakes confronting the administration as it tries to avoid last year’s mistakes and deal with new threats to the Affordable Care Act: the Republican gains in the midterm elections and the Supreme Court’s decision to review the government insurance subsidies that are a linchpin of the law.

ICYMI: WSJ--How Affordable Is the Affordable Care Act?

The Department of Health and Human Services recently released a report making the case for how Obamacare’s premium subsidies have made health insurance more affordable for individuals. But those who do not qualify for federal subsidies appear to find exchange coverage anything but affordable.

As some have noted, a separate HHS report released in May highlighted the fact that during the 2014 open-enrollment period, 13.5 million individuals were found eligible to purchase coverage on state or federal exchanges. Of these, about 8.7 million qualified for federal insurance subsidies. That means nearly 4.8 million individuals were not eligible for subsidies. And while more than three-quarters of the 8.7 million who did qualify for subsidies (or 6.6 million) selected an insurance plan, only 1.2 million of those who did not qualify for subsidies selected a plan.

In other words, only about one-quarter of those not receiving federal insurance subsidies decided that the options offered were worth selecting a plan. It’s possible that even fewer decided to pay their first month’s premium. (Worth monitoring as more data become available: Are unsubsidized individuals not paying insurance premiums at greater rates than those receiving federal subsidies?)

Several studies suggest that Obamacare’s package of mandated benefits and other regulations have increased premium levels substantially. Advocates of the Affordable Care Actsay that federal subsidies have made coverage more affordable, but others have argued that using government spending–more than $1 trillion in exchange subsidies and $1.8 trillion in spending on new coverage overall–to mitigate the effects of regulation presents a solution in search of a problem.

George Clooney stormed away during his fancy Vegas dinner with hotel tycoon Steve Wynn after Wynn called Prez Obama an asshole.

It sounds like an epic dinner. According to Wynn ... Clooney got drunk on tequila shots and when Wynn attacked the President ... he says George hurled an F-bomb and left.

Clooney says Wynn was railing over the Affordable Care Act. He says "I said that the President was my longtime friend and then he said, 'Your friend is an asshole.'" Clooney adds, "At that point I told Steve HE was an asshole and that I wasn't going to sit at his table while he was being such a jackass."

Wynn told the Las Vegas Review-Journal, "When he's [George] drinking, he considers himself a close personal buddy of the President."

Wynn passes a lot of it off to alcohol, saying, "Clooney's fun to be with when he's sober ... If you have a chance to drink with him, you want to get there early, and don't stay late."

For Clooney's part he says there were 9 people at the dinner 2 weeks ago at Botero restaurant at Wynn's Encore hotel, adding, "It had nothing to do with politics and everything to do with character."

For Wynn's part, he says, "Everybody who's in my business -- the casino business -- knows to take actors with a grain of salt."

Of the plans that states have hatched for the Affordable Care Act, none has been bolder than that of Vermont, which wants to implement a single-payer health-care system, along the lines of what you might find in Britain or Canada. One government-operated system will cover all 620,000 of Vermont’s citizens. The hope is that such a system will allow Vermont to get costs down closer to Canada’s, as well as improve health by coordinating care and ensuring universal coverage.


Just two small issues need to be resolved before the state gets to all systems go: First, it needs the federal government to grant waivers allowing Vermont to divert Medicaid and other health-care funding into the single-payer system. And second, Vermont needs to find some way to pay for it:
