U.S. House Republicans are drafting a contempt of Congress resolution against Deputy Attorney General Rod Rosenstein and FBI Director Christopher Wray, claiming stonewalling in producing material related to the Russia-Trump probes and other matters.

Intelligence Chairman Devin Nunes and other committee Republicans, after considering such action for several weeks, decided to move after media including the New York Times reported Saturday on why a top FBI official assigned to Special Counsel Robert Mueller’s probe of Russia-Trump election collusion had been removed from the investigation.

A veteran who previously spoke to Breitbart News about being stonewalled by the Department of Defense on his Freedom of Information Act requests has now filed a lawsuit to get information about toxic contamination at Fort McClellan, by which hundreds of thousands of veterans may have been exposed.

Raymond Pulliam – a 53-year-old veteran – had to retire in 2012 due to health issues that he thinks were caused by toxic chemicals he was exposed to during his basic training at Fort McClellan in Alabama. As Breitbart News previously reported, Pulliam “has sought information about Fort McClellan’s chemical contamination from the Department of Defense since last year, but his Freedom of Information Act (FOIA) request has gone unanswered.”

According to the complaint, Pulliam, the Plaintiff, is suing the Department of Defense, the Environmental Protection Agency, and the United States Department of Justice “in failing to provide Plaintiff with all non-exempt records responsive to his FOIA requests sent to each of these federal agencies, seeking records regarding their investigation into toxic contamination at former U.S. Army base Fort McClellan.”

Rasmussen Ferguson Poll: 70% Blame Urban Crime

The fallout continues in Ferguson, Missouri, following a Justice Department report accusing the city government of a widespread pattern of racial discrimination. But in most inner city communities, is racism the real problem?

Not according to 70% of Likely U.S. Voters who say the level of crime in low-income inner city communities is a bigger problem in America today than police discrimination against minorities. A new Rasmussen Reports national telephone survey finds that just 20% think police discrimination is the bigger problem. Ten percent (10%) are undecided. There’s a sharp racial difference of opinion on this question, however. Fifty-six percent (56%) of black voters believe police discrimination against minorities is the bigger problem. Seventy-eight percent (78%) of whites and 54% of other minority voters disagree and view inner city crime as the bigger issue.

The NBA consists of 76 percent black players. But blacks are just 13 percent of the country. Clearly, the league engages in racial discrimination against whites. Silly, right? Well, this is exactly what the sleight-of-hand Department of Justice pulled off to find that the Ferguson Police Department engages in "implicit and explicit racial bias"!


The report insults anybody who's ever studied the statistics - or logic.

The 105-page report concludes: "Ferguson's law enforcement practices are shaped by the City's focus on revenue rather than by public safety needs. This emphasis on revenue has compromised the institutional character of Ferguson's police department, contributing to a pattern of unconstitutional policing, and has also shaped its municipal court, leading to procedures that raise due process concerns and inflict unnecessary harm on members of the Ferguson community. Further, Ferguson's police and municipal court practices both reflect and exacerbate existing racial bias, including racial stereotypes. Ferguson's own data establish clear racial disparities that adversely impact African Americans. The evidence shows that discriminatory intent is part of the reason for these disparities. Over time, Ferguson's police and municipal court practices have sown deep mistrust between parts of the community and the police department, undermining law enforcement legitimacy among African Americans in particular."

The Washington Post immediately put out an article headlined "The 12 key highlights from the DOJ's scathing Ferguson report." Per the Post, the "scathing" statistic first listed is this: Ferguson is 67 percent black, but blacks comprised 85 percent of the traffic stops and 93 percent of the arrests. Incontrovertible proof that the Ferguson PD engages in institutional racism!

Reporters, in describing the Ferguson report, used adjectives that include "shocking," "stunning" and "eye-popping."

But if Ferguson's numbers are "eye-popping," what adjective applies to the New York City Police Department. New York City is 25 percent black. However, of the traffic stops, blacks comprise 55 percent. The statistical "gap" is 30 points. In Ferguson, as stated, the black population is 67 percent, but 85 percent of the traffic stops. The statistical "gap" is 18 points -- far smaller than New York's 30-point "gap."

Why aren't Messrs. Al Sharpton, Jesse Jackson and Eric Holder marching on Times Square?

The answer is that the liberal former New York City Mayor Michael Bloomberg, who governed for 12 years, defends the aggressive policing of the NYPD -- and the resulting "statistical disparities." Bloomberg says: "Unlike many cities, where wealthy areas get special treatment, the NYPD targets its manpower to the areas that suffer the highest crime levels. Ninety percent of all people killed in our city -- and 90 percent of all those who commit the murders and other violent crimes -- are black and Hispanic. It is shameful that so many elected officials and editorial writers have been largely silent on these facts.

"Instead, they have argued that police stops are discriminatory because they do not reflect the city's overall census numbers. By that flawed logic, our police officers would stop women as often as men and senior citizens as often as young people. To do so would be a colossal misdirection of resources and would take the core elements of police work -- targeting high-crime neighborhoods and identifying suspects based on evidence -- out of crime-fighting. ...

"That the proportion of stops generally reflects our crime numbers does not mean ... that the police are engaged in racial profiling; it means they are stopping people in those communities who fit descriptions of suspects or are engaged in suspicious activity."

The National Institute of Justice is the research and evaluation agency of the DOJ. In 2013, the NIJ published its study called "Race, Trust and Police Legitimacy." Unlike when responding to dispatch calls, police officers exercise more discretion when it comes to traffic stops. Thus, the supposedly "racial profiling" cops can have a field day when it comes to traffic stops, right?

But according to the NIJ, 3 out of 4 black drivers admit being stopped by police for a "legitimate reason." Blacks, compared to whites, were on average more likely to commit speeding or other traffic offenses. "Seatbelt usage," said the NIJ, "is chronically lower among black drivers. If a law enforcement agency aggressively enforces seatbelt violations, police will stop more black drivers." The NIJ conclusion? Numerical disparities result from "differences in offending" in addition to "differences in exposure to the police" and "differences in driving patterns."

President Obama, backed by research from the left and from the right, said, "Children who grow up without a father are five times more likely to live in poverty and commit crime; nine times more likely to drop out of school and 20 times more likely to end up in prison."

Richmond, Virginia, is a city of 214,000, with a black population of 50 percent. Eighty-six percent of black Richmond families are headed by a single parent. Of Ferguson's 67 percent black population, how many kids grew up in fatherless homes?

Whatever the answer, isn't this a far more relevant statistic?

Holder Says He's 'Prepared' To Dismantle Ferguson Police Department

Attorney General Eric Holder said Friday the Department of Justice is ready to take any and all steps that are needed to reform the Ferguson, Mo., police department, including the potential dismantling of the force.

Speaking to reporters at Andrews Air Force Base after a trip to South Carolina with President Obama, Holder said he was stunned by what the investigation uncovered, and will go to all necessary lengths to address racial bias and other systemic issues within the force. A Department of Justice report released Wednesday showed the police department demonstrated a pattern of racial bias and committed constitutional violations.

"We are prepared to use all the powers that we have, all the power that we have, to ensure that the situation changes there. That means everything from working with them to coming up with an entirely new structure," Holder said. When asked if that included dismantling the department, he said, "If that's what's necessary, we're prepared to do that."

U.S. National Security Prosecutors Shift Focus From Spies To Cyber

(Reuters) - The U.S. Justice Department is restructuring its national security prosecution team to deal with cyber attacks and the threat of sensitive technology ending up in the wrong hands, as American business and government agencies face more intrusions.

The revamp, led by Assistant Attorney General John Carlin, also marks a recognition that national security threats have broadened and become more technologically savvy since the 9/11 attacks against the United States.

As part of the shift, the Justice Department has created a new position in the senior ranks of its national security division to focus on cyber security and recruited an experienced prosecutor, Luke Dembosky, to fill the position.

The agency is also renaming its counter-espionage section to reflect its expanding work on cases involving violations of export control laws, Carlin confirmed in an interview.

Such laws prohibit the export without appropriate licenses of products or machinery that could be used in weapons or other defense programs, or goods or services to countries sanctioned by the U.S. government.

"We need to develop the capability and bandwidth to deal with what we can see as an evolving threat," said Carlin, who was confirmed to his post in April.

Representatives from the Federal DOJ Civil Rights Division, The Community Relations Service (CRS), “Peacekeepers”, are beginning the process of slowly deflating the vitriol. To avoid riots and try to stem violent expectations from not gaining Grand Jury indictment, the CRS is leaking (strategic dissemination) information to the New York Times.

WASHINGTON — The police officer who fatally shot Michael Brown in Ferguson, Mo., two months ago has told investigators that he was pinned in his vehicle and in fear for his life as he struggled over his gun with Mr. Brown, according to government officials briefed on the federal civil rights investigation into the matter.

The officer, Darren Wilson, has told the authorities that during the scuffle, Mr. Brown reached for the gun. It was fired twice in the car, according to forensics tests performed by the Federal Bureau of Investigation. The first bullet struck Mr. Brown in the arm; the second bullet missed.

Government Has No Receipts For Thousands Of UAC's

The Department of Justice does not have receipts for more than half of the unaccompanied alien children apprehended at the southwest border by Border Patrol since the start of fiscal year 2013, government records show.

U.S. Customs and Border Protection data show more than 85,000 total apprehensions of unaccompanied alien children during fiscal year 2013 and fiscal year 2014 through June. Information from the same time period provided to National Review Online by the DOJ’s Executive Office for Immigration Review shows 41,592 total receipts marked as juvenile in immigration courts. Kathryn Mattingly, spokesperson for EOIR, tells NRO the receipts refer to new Notices to Appear (NTA) — the document the Department of Homeland Security uses to charge an illegal immigrant with being removable from the United States.

EOIR has recorded 20,814 receipts marked as juvenile in fiscal year 2014 as of June 30, but Border Patrol recorded 57,525 apprehensions of unaccompanied alien children during the same time frame. This means immigration courts have receipts for fewer than four out of every ten unaccompanied alien children apprehended by Border Patrol this fiscal year. Mattingly said EOIR stands behind the numbers of receipts it has recorded, but would not speak about the difference between the number of juvenile receipts and CBP’s apprehension data.

Judge Orders Release Of Fast And Furious Documents Withheld Under Obama Exec Privilege

Thanks to a Freedom of Information Act Lawsuit pursued against the Department of Justice by government watchdog Judicial Watch, the U.S. District Court for the District of Columbia has ruled a list of documents being withheld from Congress under President Obama's claim of executive privilege must be turned over. Obama made the claim on the same day Attorney General Eric Holder was voted in criminal and civil contempt of Congress in June 2012.

"This order forces the Obama DOJ, for the first time, to provide a detailed listing of all documents that it has withheld from Congress and the American people for years about the deadly Fast and Furious gun running scandal," Judicial Watch released in a statement.

The FOIA lawsuit has been ongoing for 16-months and is now proceeding after a lengthy delay. The Justice Department originally asked the court for an indefinite hold on a FOIA request from Judicial Watch, citing executive privilege and an ongoing investigation. That indefinite hold request was shot down more than a year ago.

The documentation DOJ is required to now turn over is a "Vaughn index" of "all requested Fast and Furious materials from a June 2012 Judicial Watch FOIA request."
A Vaughn index must: (1) identify each document withheld; (2) state the statutory exemption claimed; and (3) explain how disclosure would damage the interests protected by the claimed exemption." In ordering the DOJ to provide Judicial Watch the Vaughn index, the Court ruled, “In this circuit, when an agency is withholding documents under exemption claims, courts require that the agency provide a Vaughn index so that the FOIA requester – at a distinct informational disadvantage – may test the agency’s claims.”

War On Women? AG Holder Sues Police For Treating Women as Equals

Forget about that phony IRS scandal… The DOJ apparently has a real problem to handle. The Pennsylvania State Police are being sued by Eric “The Extortionist” Holder for alleged sexual discrimination. No, the Penn police didn’t do anything as egregious as force women to pay for their own birth-control; but apparently it was enough to persuade the DOJ to file a lawsuit. The offense: Women are being held to the same standards as their male counterparts!

Apparently, requiring all candidates to pass the same standard physical fitness test is sexist. See, women are having a tough time passing the test – and this is obviously by design. According to the DOJ lawsuit:

“Through the use of these physical fitness tests, Defendants have engaged in a pattern or practice of employment discrimination against women in [Pennsylvania State Police's] selection process for entry-level trooper positions in violation of Title VII [of the Civil Rights Act of 1964].”

Those chauvinist creeps in Pennsylvania: How dare they expect a woman to be able to do a man’s work! Wait a minute… Is that really the problem here? The DOJ is suing a state police force, because they expect their female cadets to complete the same minimum requirements as men? Whoa. Maybe we should make a separate test for women that treats them as equals. I mean heck, it worked for race relations in Democrat controlled states in the 1960s, right?

Lois Lerner Targeted Sen. Grassley After He Blocked Obama’s DOJ Tax Nominee

Ex-Internal Revenue Service official Lois Lerner tried to audit Republican Sen. Chuck Grassley after Grassley blocked President Obama’s nominee to head the Department of Justice (DOJ) tax division, an executive branch insider told The Daily Caller.

Grassley made it more difficult for the IRS and DOJ to work together to target conservative groups by blocking Obama’s political appointee Mary L. Smith from taking over the DOJ Tax Division, which prosecutes criminal cases for the IRS. Grassley held up the nomination in early 2010, just as Lerner and fellow IRS officials were mapping out their targeting strategy. The White House later withdrew Smith’s nomination.

The source confirmed to The Daily Caller that the White House and IRS officials “were very upset at Senator Grassley and Republicans for blocking a vote on Mary Smith’s nomination.”

The IRS relies on the DOJ Tax Division to prosecute both criminal and civil cases, and has entire legal teams devoted to making DOJ referrals. Placing a political appointee as assistant attorney general for the DOJ Tax Division was a top priority for the Obama White House.

Grassley made sure that no Obama political nominee got confirmed for the post, and kept in a “career,” or non-political, DOJ tax head for another two years.

“The Assistant Attorney General is not the kind of position that you probably would want someone learning on the job,” Grassley said at a Feb. 4, 2010 Senate Judiciary Committee hearing, pointing out Smith’s lack of tax experience.

The broadcast networks have still not reported a new Justice Department initiative that would consider clemency for thousands of drug offenders.

As NewsBusters reported on Tuesday, Monday evening's news casts ignored the story while Fox News reported it. The broadcast network blackout continued through Tuesday and Wednesday. Fox News continued with the story on Wednesday evening as Special Report fill-in host Shannon Bream reported that "the nation's top cop today outlined a plan to get more people out of prison."

"Attorney general Eric Holder says thousands more inmates will soon be eligible for clemency," Bream provided the latest from the story. Correspondent Carl Cameron reported, "The Justice Department today announced new guidelines for non-violent drug offenders to apply for clemency from President Obama, and downplayed any risk."

Not just Fox News has reported the story, however. The Los Angeles Times said the administration's initiative "is expected to be a large-scale grant of clemency." Politico noted that the President "is preparing to make much broader use of his power to grant commutations." NPR's Politics blog noted the President will be given "far more latitude" to pardon or commute the sentences of the drug offenders.

(Washington, DC) – Judicial Watch today released a new batch of internal IRS documents revealing that former IRS official Lois Lerner communicated with the Department of Justice (DOJ) about whether it was possible to criminally prosecute certain tax-exempt entities. The documents were obtained as a result of an October 2013 Judicial Watch Freedom of Information Act (FOIA) lawsuit filed against the Internal Revenue Service (IRS) after the agency refused to respond to four FOIA requests dating back to May 2013.

The newly released IRS documents contain an email exchange between Lerner and Nikole C. Flax, then-Chief of Staff to then-Acting IRS Commissioner Steven T. Miller discussing plans to work with the DOJ to prosecute nonprofit groups that “lied” (Lerner’s quotation marks) about political activities. The exchange includes the following:

I got a call today from Richard Pilger Director Elections Crimes Branch at DOJ … He wanted to know who at IRS the DOJ folk s [sic] could talk to about Sen. Whitehouse idea at the hearing that DOJ could piece together false statement cases about applicants who “lied” on their 1024s –saying they weren’t planning on doing political activity, and then turning around and making large visible political expenditures. DOJ is feeling like it needs to respond, but want to talk to the right folks at IRS to see whether there are impediments from our side and what, if any damage this might do to IRS programs. 
I told him that sounded like we might need several folks from IRS…
