Police Baffled By ‘Random’ Hollywood Murder Of Woman On Street

Baffled Los Angeles cops canvassed a popular Tinseltown tourist area on Tuesday, scrambling for any clues into the seemingly senseless murder of a woman walking down the street.

Carrie Jean Melvin, 30, and her boyfriend were strolling on Sunset Boulevard near McCadden Place just after 10 p.m. Sunday when a man walked up behind her, pointed a shotgun and opened fire, police said.
The suspect jumped into a black sedan and got away. The boyfriend was not injured in the brutal attack and stayed with his mortally wounded gal pal, police said.

“We’ve interviewed the boyfriend, there’s no indication that they had any idea there were enemies [of Melvin], that she would be targeted, so at this point, we just don’t know,” said LAPD Detective John Skaggs.

The vice president of the Los Angeles Police Commission strongly defended the panel's finding in the Ezell Ford shooting case, saying that a 2013 California Supreme Court decision required them to look at the circumstances that led up to the incident and not just the shooting itself.

Paula Madison, a former executive at NBCUniversal, cited the state high court's ruling in the case of Hayes vs. San Diego as the reason why LAPD officer Sharlton Wampler was found to have violated department policy in Ford's death. The "Hayes" decision allowed panels revising use of force issues to take the totality of an officer's conduct into account.

"The pre-shooting actions taken by the police, come into consideration and that changed everything," Madison said in a taping of NBC4's "News Conference" program.

Sources: Video Of LAPD Shooting In Venice Doesn't Explain Officer's Actions

Security video of a deadly encounter between two LAPD officers and an unarmed homeless man in Venice shows a brief struggle between the officers and the man but does not explain why one officer stepped away and opened fire, law enforcement sources said.

The recording shows the officer standing up and moving away from the Tuesday night altercation, ultimately standing a few feet away from the man when he fired what appeared to be two shots, the sources said.

The Times spoke to several people who have reviewed the footage, which has not been made public. The sources spoke on the condition of anonymity because they were not authorized to discuss the recording publicly.

The sources said the recording showed the officers struggling with the man and successfully taking him to the ground. One source said it appeared the officers had control over him.

But then, the sources said, one of the officers stood up and began to move away. As he did that, they said, the man began to stand up and started struggling with the second officer.

For reasons that are unclear on the video, the sources said, the first officer then fires his weapon.

The sources noted there was no audio on the recording but said there was no visible physical action by the man that could explain why the officer shot him.

An actress who accused Los Angeles police of racially profiling her after she was accused of having sex with her boyfriend in a parked car last year was ordered Monday to apologize to officers.

Daniele Watts, best known for her appearance in the 2012 film "Django Unchained," pleaded no contest to disturbing the peace with loudness and was ordered to write an apology to three police officers and the occupants of a building near where she was briefly detained this past September in Studio City, Calif.

As part of their plea deal, Watts and her boyfriend, Brian Lucas, were also ordered to perform 40 hours each of community service, according to the Los Angeles City Attorney's Office. The case will be dismissed and not appear in public records if the pair remain out of trouble for one year.

Watts and Lucas were also charged with lewd conduct, but that count was dismissed Monday.

Police officers were investigating a report of two people having sex in a car on Sept. 11 when they questioned Watts and Lucas. Watts claimed they were just kissing and accused the officers of racial bias. The pair were eventually released.

LAPD Officer Accused Of Trying To Smuggle Mexican Citizen Across Border

A 10-year LAPD officer and a second person were charged by federal prosecutors Monday with trying to smuggle a Mexican citizen into the United States in the trunk of a car at the Otay Mesa border crossing.

Officer Carlos Curiel Quezada Jr., 34, and Angelica Godinez, 31, were stopped by U.S. Customs and Border Protection officers Saturday evening when they drove a white 2014 Nissan Juke through the border crossing.

The pair showed their passports and said they were headed to Mission Hills, according to the federal charging document. But when the car was inspected by a device that acts like an X-ray machine at a secondary inspection point, authorities noticed something unusual about the trunk.

When law enforcement popped the trunk, they found Antanasio Perez-Avalos, 26, hiding in the spare tire compartment, according to federal prosecutors.

Perez-Avalos “is a Mexican citizen with no legal ability to enter the United States,” U.S. Customs officials said.

Emotions were running hot across the country Monday after a viral Facebook video showed Los Angeles police shooting and killing a man in the city's Skid Row district, where homeless people camp in the city's downtown.

Because the man appears in the four-minute video to be on his back on the ground when shots are fired, some have blasted the police, saying excessive force was used. The police, who said they were answering a call about a robbery, have said they are investigating the incident. Los Angeles Police Chief Charlie Beck said Monday that the man reached for an officer's gun.

A witness told the Los Angeles Times the man reached for an officer's weapon.

The cold case became hot in November when a man called USC, saying he had purchased the trophy from a friend years ago and wanted to authenticate it. The USC folks determined the guy did indeed have the Heisman, but cops didn't believe his story ... they think he's the crook.

So LAPD detectives went to court last month and got a warrant to track the guy down and nab the items.

The LAPD said 183 demonstrators were arrested early Wednesday for disorderly conduct after downtown protests over the Mike Brown grand jury decision threatened public safety.

Dozens of protesters were detained at Broadway and Temple Street around 3 a.m., many of whom were young adults who were repeatedly asked to disperse.

According to the LAPD, Francisco Garcia attended a party with several friends on Saturday evening at a home located on Dronfield Street.

Around 2:00 a.m. Sunday, those who attended the party moved up the street to a different location.

Watts was reportedly teary-eyed, declaring, "at a certain point, enough is enough and somebody has to say something," according to the Los Angeles Times.

She explained that it was not only a traumatic experience she had when she was 16, involving a white police officer and her father, which caused her to pull the race card on Sgt. Jim Parker in North Hollywood on September 11. Watts added that the incidents in Ferguson further propelled her reaction to Sgt. Parker when he arrived to investigate a claim that she and boyfriend Brian James Lucas were making love in public.

A suspect loitered around a bank near Jefferson and Crenshaw boulevards at 10:45 a.m. on Oct. 1. He surveyed several potential victims and then chose a 67-year-old woman. When she left the bank, he followed her to her residence in the 3000 block of 10th Avenue.

The LAPD officer who leaked the audio recording of Django Unchained actress Daniele Watts being detained to TMZ last month says he thinks he'll be losing his job.

Sgt. Jim Parker, a 25-year LAPD veteran, told The Wrap that he's been put in a "penalty box" while the LAPD is investigating his conduct. He said, "I can't wear a uniform, I can't be on patrol and I can have no civilian contact."

Just yesterday, Watts and her boyfriend, raw food chef Brian Lucas, were both charged with lewd conduct in public for allegedly having sex in their car with the doors wide open in broad daylight on Sept. 11. When Parker responded to the call, he handcuffed and detained Watts after she refused to show authorities her ID, but later let her go, saying that there was no evidence of any crime committed. However, the couple argued that officers racially profiled them because Watts is black and Lucas is white, and said the officers acted like Lucas was a john and Watts his prostitute.

Parker thinks he's in more hot water than Watts. He told The Wrap, "I've got more charges against me than she has against her." The LAPD is charging him with insubordination for giving TMZ an audio recording that revealed the conversations he had with Watts during her detainment, he said.

Even though he was ordered by the LAPD not to talk to the media, he defended his actions to the L.A. Times in an interview last month: "I had to make a decision. We were facing another racial, tumultuous incident in L.A. I said, 'This has to stop right away.' I drove to my work station, grabbed the recording and called TMZ. It stopped the next day."

GUEST LEGAL OPINION: Daniele Watts: Where's The Apology?

Now that there is more information about the Daniele Watts situation, I offer some final thoughts based upon what we now know.

The 911 calls reported seeing a woman and a man engaged in sexual intercourse in a car with the door open. This is a violation of Penal Code section 647, subd.(a), engaging in lewd or dissolute conduct in any public place or place exposed to public view. So when the police responded to the 911 call and came upon the described couple in a car at the described location, they were lawfully entitled to detain the couple to investigate the reported crime.

Regarding demanding identification, open acts of sexual intercourse like this would lead to a reasonable belief on the part of officers that the woman was engaging in an act of prostitution. They don’t have probable cause to arrest, but they do have reasonable suspicion to detain. Since prostitutes very often have criminal records and are on probation, it would be reasonable for officers to obtain the identification of the woman to see if she has prostitution priors, if she is on probation for it, and if she has a search and seizure condition.

Thus, in accordance with the language of the Hiibel case (which I discussed in my posting last week), the request for identification was “reasonably related to the reason for the detention.” Therefore, when Miss Watts refused to provide her identification upon demand, she could then be arrested for delaying or obstructing an officer in the lawful performance of his duties in violation of Penal Code section 148, subd.(a)(1). So Miss Watts could have been arrested for refusing to provide her identification.

But there is another basis upon which Miss Watts could have been arrested. During the course of Miss Watts’ detention, she tried to walk away saying officers had no right to hold her. But a person who is lawfully detained cannot simply walk away. Doing so is also a violation of Penal Code section 148, subd.(a)(1). So she could have been arrested for that as well.

As authority for this, please note the following quotation from the case of People v. Lloyd (1989) 216 Cal.App.3d 1425,1429, in which a motorist walked away from an officer attempting to give him a ticket for a traffic violation: With no right to resist this lawful detention, Calvin’s conduct in quickly walking away from the officer rather than complying with the demand for identification provided the officer with probable cause to arrest him (Pen. Code, section 148).

The fact is the LAPD sergeant exercised wise discretion in deciding Miss Watts’s conduct -- although unlawful and contemptuous -- did not merit an actual arrest. The detention in the street and the temporary handcuffing was enough. So he let her go. She was lucky.

LOS ANGELES (KABC) -- Civil rights activists called for actress Daniele Watts to apologize to the LAPD and the community after claiming she was racially profiled and illegally detained.

"We took her word that she had been a victim, but now we know it's not true," said Najee Ali with Project Islam Hope. "So we feel that she has done a disservice to the community and especially those in the civil rights community who backed her claim initially."

Watts was detained last Thursday in Studio City after she and her boyfriend were questioned by the LAPD. Officers were responding to reports of a couple engaging in lewd behavior in a parked car.

She said she was kissing her boyfriend in the front seat of a parked car and accused the police of racial profiling. An audio recording later released by the responding officer reveals Watts refused to identify herself to police.

Earl Ofari Hutchison of the Los Angeles Urban Policy Roundtable said the LAPD acted appropriately.

"Don't make us look dumb," Hutchison said. "Don't make yourself look stupid. Because when you do that, you totally do a disservice to what we consider is still a compelling, major, deadly issue, and that's racial profiling."

The tide of public opinion seems to have fully turned against actress Daniele Watts after she suggested racial profiling was behind her police stop in Studio City last week.

Her white boyfriend, self-proclaimed "rawk star chef" Brian James Lucas, went so far as to say cops questioned Watts and himself as if they were "ho and trick." Los Angeles Police Department audio of some of the confrontation, however, revealed absolutely zero racism at play. And TMZ photos of the pair appeared to show them having sex in a car, or something close to it, which was the reason for a police response all along, according to the LAPD.

Now some of L.A.'s most prominent African American leaders are denouncing Watts:

Project Islamic Hope President Najee Ali, Los Angeles Urban Policy Roundtable President Earl Ofari Hutchinson and other local civil rights leaders have lined up against Watts' claims that her race drove police to single her out for an investigation on the afternoon of Sept. 11.

The leaders will officially call her out during a 9:30 a.m. press conference today at the studios of KTYM 1460 AM in Inglewood, according to a statement. They also "demand" that the actress to apologize to the LAPD.

The leaders say new information has "cast doubt" on Watts' claim against the cops.

The actress, known for her work in Django Unchained and Weeds, told a sergeant who stopped her for questioning, "Do you know how many times the cops have [been] called for being black?"

She repeatedly refused the cop's request for her name or identification, saying that she didn't have to give up her identity, a claim that's disputed by interpretations of the law from some of the largest District Attorney's offices in California.

It's a story that went viral -- Daniele Watts, a black actress claiming she was detained by the LAPD for kissing her white boyfriend in public.

Civil rights advocates jumped to her defense, including Earl Ofari Hutchinson.

"I was one that was very outspoken about it," he said. "We take racial profiling very seriously. It's not a play thing. It's not trivial."

Since the incident, an audiotape has been released in which Watts can be heard refusing to show identification to the officer, who was responding to a call generated by an observer who reported Watts and her boyfriend were engaged in a lewd act in a car on a public street corner.

The police sergeant involved has protested Watts' claims and photos showing Watts straddling her boyfriend in the passenger seat of a car have surfaced. Employees of nearby businesses have also spoken to news outlets and described the behavior that generated the call as more graphic than kissing.

Hutchinson said the audio recording and photos cast doubt on Watts' account and he is now calling on the actress to apologize to the LAPD.

LAPD Chief Charlie Beck has said that he believes the officers who detained the actress after responding to a report of a couple engaged in lewd behavior inside a car in Studio City acted properly.

He said Thursday that he looks forward to finding out what "really happened."

"Django Unchained" actress Daniele Watts' BF is sticking to their story -- that they were fully clothed and NOT HAVING SEX -- and he thinks TMZ's pics of the scene prove they were only making out.

Brian Lucas tells us he and Watts found the photos of their front seat romp "quite entertaining and fascinating" -- but says there's nothing in the photos that shows them banging. He also says there are no photos of Watts' breasts exposed because it never happened ... as witnesses claim it did.

Bottom line, Lucas says there's no hard proof sex was involved ... "only assumptions."

We broke the story ... Lucas and Watts were questioned by cops who responded to reports of indecent exposure after people saw the couple going at it. Watts claimed cops were racist and roughed her up.

Lucas tells us they met with the LAPD Tuesday to give them an official statement about the incident.

The Django Unchained actress who claimed she was harassed by LAPD officers who unfairly arrested her when she was making out with her boyfriend appears to have been doing a lot more than just kissing.

Pictures obtained by TMZ show Daniele Watts straddling her boyfriend Brian James Lucas in his car while the couple steady themselves with their hands on the car sunroof.

Eyewitness accounts suggest that Watts was grinding on top of her boyfriend with her shirt pulled up and her breasts exposed.

An eyewitness who saw the couple as he worked in a nearby office told TMZ that Lucas was sitting in the passenger seat with his feet on the curb and Watts was straddling him and rocking back and forth.
