The police say they were just doing their jobs—and besides, the 12-year-old attacked them. But a 911 call by a pool employee reveals concerns over race.

Krystal Dixon dropped off her kids and nieces and nephews at the Fairfield, Ohio, pool just as she’d done many times before. Not a half-hour later, the family was being rushed to the hospital after a violent altercation with local police.

The incident started so small. When one child didn’t have swimming trunks, staff demanded the family leave.

Even though Dixon, pregnant and 33, said she had a swimsuit for the child, workers at the Fairfield Aquatic Center—about 25 miles north of Cincinnati—said it was too late.

What was a minor breach of pool rules then descended into chaos: A white officer using pepper spray on black teenage girls, and one 12-year-old—Dixon’s niece—being slammed against a cop car. Her family says she has a fractured jaw and broken ribs.

CLEVELAND, Ohio — Cleveland police will stop hitting people on the head with their guns and document any time they unholster them, according to a consent decree between the U.S. Justice Department and Cleveland police released today.

The Justice Department found in a 21-month investigation that began in 2013 that Cleveland police routinely bash people on the head with their guns, sometimes accidentally firing them, according to a 58-page report released in December.

The consent decree released Tuesday between the U.S. Department of Justice and the city of Cleveland is the result of five months of negotiations, as well as dozens of meetings with community groups, church leaders and advocates. Once approved by a federal judge, the city is legally bound to enact the reforms included in the 105-page document, meant to protect citizens' Constitutional rights.

"[Cleveland Division of Police's] policy will expressly provide that using a firearm as an impact weapon is never an authorized tactic," the consent decree says.

In the final three paragraphs of a "Year in Review" item at the Los Angeles Times on December 31 (HT Patterico), reporter Matt Pearce joined the long list of journalists who have failed to properly characterize the evidence in Michael Brown's death in Ferguson, Missouri in August. You had to know that distortions were coming based on the rest of the article content which preceded it. The most obvious giveaway was Pearce's description of Eric Garner's death on Staten Island.

It didn't take long for the gunmen to return to the scene of the crime. And when they came back, to say they were armed to the teeth would be an understatement. Some rolled through the streets of a working-class American suburb in an armored personnel carrier, while others clutched onto to ferocious dogs that kept the citizens of the town at bay. The images were frightening -- as if Bull Connor's henchmen in Birmingham's civil rights struggles of 1963 had been dropped into the geographic center of America 51 years later -- but the militarized cops of Ferguson, Mo., accomplished their mission.

They kept the public from getting the answers they need, the answers they deserve.

Why was yet another unarmed young black man -- this one just 18 -- shot and killed? Why did it have to be a solid kid like Mike Brown, a young man who made it through high school and was supposed to start his college classes tomorrow morning? When is excessive police force in this country -- which is clearly unchecked and out-of-control -- finally going to be reigned in, in a land that pledges allegiance to liberty and justice for all?

After all, the Missouri slaying of Mike Brown -- reportedly hands-up, without a weapons and running away from the cops -- is outrageous, and yet it is yet hardly an isolated incident. It comes as activists in New York City are still pressing for action in the case of Eric Garner, an African-American who was arrested on Staten Island for the lowest-possible-level crime of selling untaxed cigarettes, placed in a chokehold -- a move supposedly banned years ago -- and (according to the medical examiner's office) murdered.

Police have become increasingly at odds with Mayor Bill de Blasio over the appearance he is taking sides against them after the chokehold death of a black suspect last month — a conflict that has prompted the city's top law enforcement official to do damage control by calling the mayor "very pro-cop."

What angered many was a recent forum in which the Rev. Al Sharpton, one of the biggest critics of the New York Police Department, was seated alongside the mayor, a liberal Democrat, and the police commissioner as he lambasted law enforcement and suggested the mayor's mixed-race son would be a "candidate for a chokehold" if he were an ordinary New Yorker. The image was seized on by critics of the administration and plastered on the cover of the New York Post with the headline "Who's the Boss!"

"It is outrageously insulting to all police officers to say that we go out on our streets to choke all people of color as Al Sharpton stated while seated at the table right next to our mayor at City Hall," said Patrick Lynch, head of the powerful Patrolmen's Benevolent Association. Another union official, Ed Mullins of the Sergeants Benevolent Association, hinted at a work slowdown at the nation's largest police department.

Former Mayor Rudolph Giuliani even weighed in, saying in a radio interview that de Blasio made a "big mistake ... setting up a press conference like that and putting a police commissioner in that situation. That's extremely damaging to the police commissioner, to keep up the morale of the police."

In recent days, emails have circulated among police officers showing a mock identification card with a picture of Sharpton and the title "Police Commissioner." The activist has shot back by claiming he has the ear of federal officials who have the authority to bring civil rights charges in the death of Eric Garner.

"It is time to have a mature conversation about policing rather than immature name calling and childish attempts to scapegoat," Sharpton said in a statement.

Police Commissioner William Bratton responded to the uproar by giving a series of interviews Friday defending his department's record on race and de Blasio's attitude toward the department.

"We are not a racist organization," Bratton told The Associated Press. "And I will challenge anybody despite their perceptions of police on that issue. This is a department that goes where the problems are — whether it's crime or disorder."
