Corruption From The IRS To The DOJ

By Scott Johnson, May 11, 2015, Powerlineblog.com

The pro-Israel group Z Street had its application for tax-exempt status held up at the IRS. When founder Lori Lowenthal Marcus asked why, she was told that IRS auditors had been instructed to give pro-Israel groups special attention and that Z Street’s application had been forwarded to a special IRS unit for additional review. Not to put too fine a point on the legal issues, this isn’t kosher. It’s illegal.

Z Street filed a lawsuit against the IRS in the rosy dawn of the Age of Obama; the lawsuit has yet to get beyond the IRS’s motion for dismissal. The Free Beacon’s Alana Goodman wrote about the lawsuit here last year when the DC District Court denied the IRS motion to dismiss the case. Z Street’s Lori Marcus wrote about it here. John wrote about it in 2013 in the post “The other IRS scandal.”

The legal positions asserted by the IRS are ludicrous. Indeed, they are a pretext to preclude discovery until the chief malefactors serving at the pleasure of President Obama have moved on. It is a sidebar to the political corruption of the IRS that remains one of the great untold stories of the Age of Obama. (Sharyl Attkisson doesn’t cover the IRS scandal, but to understand the Obama playbook for handling it, see “The Attkisson file.”)

BOMBSHELL MEMO: Jeanne Shaheen Conspired With WH Insider On IRS Targeting Scandal

Patrick Howley, Nov. 3, 2014, Daily Caller

Democratic New Hampshire Sen. Jeanne Shaheen was principally involved in a plot with Lois Lerner and President Barack Obama’s political appointee at the IRS to lead a program of harassment against conservative nonprofit groups during the 2012 election, according to letters exclusively obtained by The Daily Caller.

The Internal Revenue Service (IRS) did not want to publicly release 2012 correspondences exchanged between the IRS and Jeanne Shaheen at her personal Washington office: the agency delayed releasing the information to a major conservative super PAC multiple times, even threatening to see the super PAC in court, according to emails.

Rogue Pastors Endorse Candidates--IRS Looks Away

Photo via Flickr
Rachael Bade, Nov. 3, 2014, Politico

A record number of rogue Christian pastors are endorsing candidates from the pulpit this election cycle, using Sunday sermons to defiantly flout tax rules.

Their message to the IRS: Sue me.

But the tax agency is doing anything but. Although the IRS was sued itself for not enforcing the law and admitted about 100 churches may be breaking the rules, the pastors and their critics alike say the agency is looking the other way. The agency refuses to say if it is acting.

At the same time, the number of pastors endorsing candidates in what they call Pulpit Freedom Sunday jumped from 33 people in 2008 to more than 1,600 this year, according to organizers, Alliance Defending Freedom. And this year, they’ve stepped up their drive, telling pastors to back candidates any Sunday up until the election, not just one Sunday as in past years.

GOP Offers Refresher On IRS Controversy

Bernie Becker, Oct. 27, 2014, TheHill.com

The House GOP video traces the IRS’s treatment of Tea Party groups back to 2010, when President Obama criticized the Supreme Court’sCitizens United decision, to the agency’s acknowledgement more than four months ago that it couldn’t find all of former IRS official Lois Lerner’s emails. The video also criticizes the IRS’s efforts to craft new regulations governing the 501(c)(4) groups involved in the controversy.

IDB: Recent Scandals Show It's Time To Abolish IRS

By Lewis Uhler and Peter J. Ferrara, Aug. 12, 2014, News.investors.com

The Constitution states in Article I, Section 8: "The Congress shall have the power to lay and collect taxes ... ." The 16th Amendment enacted in 1913 restated: "The Congress shall have the power to lay and collect taxes on incomes ... ."

There is no mention of a presidential role in either imposing or collecting taxes.

Congress abdicated its constitutional role in tax collection in 1862, when it prescribed an income tax to be collected by a newly-created Internal Revenue Commission in the Treasury Department. Since then, there have been a series of presidential abuses of the IRS, which now has lapsed into virtually a campaign arm of "Team" Obama.

Today, IRS bureaucrats directly flout Congress and stonewall investigations of abusive, partisan political activity, with technologically impossible claims of lost emails. What would the IRS say if you filed your tax return claiming your computer crashed and you hopelessly lost all records of your income a year ago?

The only solution is to return to the Constitution, abolish the IRS under presidential control and replace it with a congressional tax collection bureau reporting to Congress. Lois Lerner and all her IRS colleagues who refuse to cooperate with Congress would then simply be fired — instead of called to testify.

Members of Congress would be more responsive to complaints from constituents on arbitrary and abusive treatment by tax collection bureaucrats. Such constituent complaints would also spur Congress to enact tax reform that would simplify and streamline the tax code.
