Lawmakers Say Mexico Close To Releasing Marine Sgt. Tahmooressi From Prison

Members of the House Foreign Affairs Committee said Wednesday that they believe Mexico will soon release Sgt. Andrew Tahmooressi, the U.S. Marine who has been held prisoner in Mexico after he crossed into that country carrying weapons in violation of Mexican law.

Chairman Ed Royce (R-Calif.) said he met with Tahmooressi in prison back in June, and has continued to press Mexican authorities for his release. Royce said he made a breakthrough in a talk last week with Mexican authorities about Tahmooressi, who has been diagnosed with Post Traumatic Stress Disorder.

“Last week I had a good and productive conversation with the Mexican Attorney General and am confident that a humanitarian release of Andrew will occur very soon so he can start getting better,” Royce said at the start of a House hearing on the matter Wednesday.

At the hearing, Rep. Matt Salmon (R-Ariz.) added that Mexico’s Attorney General has told lawmakers that Tahmooressi can be released once Mexico receives proof of Tahmooressi’s medical condition. Salmon said lawmakers just sent medical information about Tahmooressi to Mexico, which is why they hope he may soon be able to return home.

“He has the authority within Mexican law to dismiss Sgt. Tahmooressi’s case on humanitarian grounds once he has expert testimony that verifies his combat-specific PTSD diagnosis,” Salmon said. “Chairman Royce and I obtained the appropriate expert medical reports, and forwarded them to the Mexican Attorney General’s desk this past Friday.”

Rep. Randy Weber (R-Texas) and a handful of other House Republicans want the U.S. to cut off all foreign aid to Mexico and three Central American countries until they take steps to stop the flow of unaccompanied children across the U.S. border.

Weber’s Illegal Entry Accountability Act seeks to create an incentive for these countries to ease what has become a humanitarian crisis at the border, as the U.S. scrambles to detain and process tens of thousands of children. The bill also reflects the rising GOP frustration with the Obama administration, which many say caused the problem through its efforts to ease immigration laws.

“The recent influx of unaccompanied alien children has become a humanitarian crisis, and has proven that certain laws are working against the United States of America,” Weber said.

“Texas, a border state, has repeatedly asked for help from the White House to mobilize our National Guard, and there has been no answer from the president or his administration,” he added. “Frankly, the Border States have been left hanging to fend for themselves, increasing the health and security risks to our citizens.”

Weber’s bill would cut off at least $400 million per year in foreign aid to Mexico, Guatemala, El Salvador and Honduras. Most of the children coming across the border come from the latter three countries, but the bill also targets Mexico for failing to enforce its northern and southern border.

According to ForeignAssistance.gov, Mexico received $265 million in foreign aid in 2013. Guatemala received $84 million, Honduras got $52 million, and El Salvador received $27 million. But other websites argue that U.S. foreign aid totals are higher when military aid is counted.

The Internal Revenue Service has guidelines that require all IRS employees to keep printed copies of all work-related emails.

That means even if the IRS did experience a computer crash that makes it unable to retrieve certain emails to and from former IRS employee Lois Lerner, as the IRS is claiming, those emails should have been printed out and kept on file by Lerner. And if Lerner failed to do that, she violated IRS rules.


The IRS shocked members of Congress late Friday by telling them it was unable to find emailsbetween Lois Lerner and people outside the IRS between early 2009 and April 2011. IRS officials told the House Ways & Means Committee that a computer crash would make it impossible to get those emails back.

Republicans reacted angrily by saying they doubted the IRS story, and that a forensic audit needs to conducted to find out what happened. Lerner has been the target of GOP investigations into the IRS targeting scandal, as they believe she was directly involved in delaying applications from conservative groups seeking tax-exempt status.

But even if the IRS is telling the truth about the computer crash, its own employee procedures indicate that Lerner should have paper copies of all her emails on file.

The IRS maintains an Internal Revenue Manual, and chapter 10, section 3 of that manual deals with standards for using email. Those standards, which apply to “all IRS employees,” make it clear that paper copies of all emails must be maintained.

Section 3 states that, “All federal employees and federal contractors are required by law to preserve records containing adequate and proper documentation of the organization, functions, policies, decisions, procedures, and essential transactions of the agency.”
