Lois Lerner 'Missing' Email Tapes Found, Criminal Probe Ensues At The IRS

The IRS Inspector General’s office admitted to the House Oversight Committee that backup tapes of Lois Lerner’s emails that IRS Commissioner John Koskinen had said were irretrievably lost have been found, according to a Thursday story in the Washington Times. Indeed it took only 15 days of work to track them down in a backup facility, The IRS Deputy IG has told Congress that a criminal investigation is under way into a possible cover-up.

The revelation has caused radio talk show host Rush Limbaugh to rhetorically roll his eyes. Limbaugh mentioned that the IRS is still refusing to hand over the tapes under the flimsy excuse that they were written under an old operating system and were thus unreadable using the current operating system that the tax agency uses. And thus the stonewalling and cover-up continues.

Injustice Department? Telephone Call Reveals Holder's Lawless Agency

A news story that should have -- or would have -- garnered more coverage by major news organizations failed to achieve its proper attention thanks to the frenzy over the Islamic State of Iraq and Syria's murderous rampage, the media's obsession with football star Ray Rice's domestic violence story, and the media's knee-jerk protection of a failed President Barack Obama. In fact, not one Sunday morning news show even mentioned how the Justice Department attempted to conspire with a Democrat lawmaker to allegedly sabotage the probe of the Internal Revenue Service's targeting of conservative nonprofit organizations.

According to a letter from the House Oversight Committee's leader, Rep. Darrell Issa, R-California, a top member of Attorney General Eric Holder's staff, Brian Fallon, is accused of accidentally telephoning House Oversight Committee chairman's office to ask for help leaking fabricated stories about the IRS’s scrutiny of conservative groups to news outlets. Fallon allegedly thought he had telephoned the office of Rep. Elijah Cummings, D-Maryland, who is also on that same committee and who has been extremely vocal on behalf of the IRS and Justice Department claiming there is no scandal.

On the day the House Oversight Committee held Lois Lerner in contempt, Sen. Ted Cruz (R-TX) said Congress should impeach Attorney General Eric Holder if he does not indict those like Lerner for their roles in the IRS's targeting of conservative groups.


In a Thursday appearance on Sean Hannity's radio program, Cruz said Holder should be impeached for "defying Congress and the rule of law." He said Holder's actions were not in the spirit of the Department of Justice, which Cruz said has "a bipartisan tradition of resisting partisan pressure and upholding the rule of law." Cruz cited examples of Holder's predecessors (Janet Reno and Elliot Richardson, respectively) from Bill Clinton's and Richard Nixon's administrations. 

Cruz said he was "very pleased" that Lerner was held in contempt by the House Committee but noted that the Justice Department has not indicted one person eight months after the inspector general concluded that the IRS had wrongfully targeted conservative groups. He blistered the Obama administration for appointing a Democrat who was a bundler for Obama's campaign to head the IRS investigation, and he said that would be akin to John Mitchell investigating Richard Nixon.

New IRS emails released by the House Oversight Committee show staff working for Democratic Ranking Member Elijah Cummings communicated with the IRS multiple times between 2012 and 2013 about voter fraud prevention group True the Vote. True the Vote was targeted by the IRS after applying for tax exempt status more than two years ago. Further, information shows the IRS and Cummings' staff asked for nearly identical information from True the Vote President Catherine Engelbrecht about her organization, indicating coordination and improper sharing of confidential taxpayer information.

Chairman of the House Oversight Committee Darrell Issa, along with five Subcommittee Chairmen are demanding Cummings provide an explanation for the staff inquiries to the IRS about True the Vote and for his denial that his staff ever contacted the IRS about the group.
“Although you have previously denied that your staff made inquiries to the IRS about conservative organization True the Vote that may have led to additional agency scrutiny, communication records between your staff and IRS officials – which you did not disclose to Majority Members or staff – indicates otherwise,” the letter to Cummings states. “As the Committee is scheduled to consider a resolution holding Ms. Lerner, a participant in responding to your communications that you failed to disclose, in contempt of Congress, you have an obligation to fully explain your staff’s undisclosed contacts with the IRS.”


The first contact between the IRS and Cummings' staffers about True the Vote happened in August 2012. In January 2013, staff asked for more information from the IRS about the group. Former head of tax exempt groups at the IRS Lois Lerner went out of her way to try and get information to Cummings' office.The information Cummings received was not shared with Majority Members on the Committee.

On January 28, three days after staffers requested more information, Lerner wrote an email to her deputy Holly Paz, who has since been put on administrative leave, asking, “Did we find anything?” Paz responded immediately by saying information had not been found yet, to which Lerner replied, “Thanks, check tomorrow please.”
