Larry Elder: Holder Wants Lower Legal Standards To ‘Go After a Bunch of White Guys’

MALZBERG: “All right. Let’s move on. I want you to hear what Eric Holder had to say. Apparently, he is doing all these farewell interviews even though there’s no successor confirmed yet and —“

Elder: “Not on my show, Steve. Not on my show!”

MALZBERG: “No, no, no. And not on Fox either from what I’m told but not on this show either. But listen to what he said when asked — he was talking about the inability to bring civil rights charges against George Zimmerman and probably against that should be officer in Ferguson. And here is what he said.”

HOLDER: “I think some serious consideration needs to be given to the standard of proof that has to be met before federal involvement is appropriate. That’s something that I’m gonna be talking about before I leave office ... I think that if we adjust those standards we can make the federal government a better backstop, make us more part of the process in an appropriate way to reassure the American people that decisions are made by people who are really disinterested. I think if we make those adjustments, we will have that capacity.”

MALZBERG: “He is the furthers and this government and this administration is furthers from disinterested people. He would have loved to have gone after him and brought the [indecipherable] of Zimmerman and the cop in. But he wants to address the standards. You mean make it easier to give guys basically double jeopardy?”

ELDER: “My goodness! Whatever happened to probable cause so much more beyond a reasonable doubt and to a moral certainty —let’s lower the standards so we can go after bunch of white guys who ultimately won’t even be convicted if the standard is beyond a reasonable doubt. It absolutely asinine. What he is really saying is, I’m so sorry. I could not figure out some sort of way of hammering Darren Wilson and Traywon and George Zimmerman. I could not figure out, I wish I could. I will try next time. I will try harder. It’s absurd.”

MALZBERG: “It is. You know what it is? It’s frightening.”

ELDER: “Yes.”

MALZBERG: “And thank God — I mean, I don’t know you lower that standard. I didn’t even know, but —; I mean, I don’t even know how you would go back doing that but I have confident that this nation would never let that happen I don’t know what scheme he has in mind or how well the standards will. I guess they can just pick and choose who they want to bring charges against and that should be enough.”
