Dems Declare War On Words 'Husband,' 'Wife'

By Pete Kasperowicz, July 9, 2015
Washington Examiner

More than two dozen Democrats have proposed legislation that would eliminate the words "husband" and "wife" from federal law.

Those "gendered terms" would be replaced by "gender-neutral" words like "spouse" or "married couple," according to the bill from Rep. Lois Capps, D-Calif.

"The Amend the Code for Marriage Equality Act recognizes that the words in our laws have meaning and can continue to reflect prejudice and discrimination even when rendered null by our highest courts," Capps said. "Our values as a country are reflected in our laws. I authored this bill because it is imperative that our federal code reflect the equality of all marriages."

The Supreme Court ruled in June that the 14th Amendment to the Constitution means all states have to license same-sex marriages, a ruling that effectively ended the same-sex marriage debate in America. Capps said her bill was aimed at taking the next step, which is to ensure the United States Code "reflects the equality of all marriages."

Intermarriage: A Real Measure Of Race Relations

Naomi Schaefer Reilly, Dec. 29, 2014, New York Post

Our liberal elites have plainly decided it’s better if we’re all convinced that our country had made no progress on race since 1960, that lying just beneath the surface of every white person is a gurgling volcano of racial epithets ready to spew forth at the slightest provocation.

The current trend toward chronicling “microaggressions” (bits of racism so small you might not even see them as racism) is, if anything, evidence of the lack of a problem

Officer Darren Wilson Marries Ferguson Officer Girlfriend

By Staff Writer, Nov. 24, 2014, Fox2now.com

CLAYTON, MO – Officer Darren Wilson married his girlfriend last month. The St. Louis Post-Dispatch reports Wilson, 28, married a 36-year-old woman who is also a Ferguson police officer. This is Wilson’s second marriage.

The couple applied for a marriage license at the St. Louis County courthouse. The couple went unnoticed when they filled out the application. Judge Christopher Graville performed the informal ceremony in Overland.

Darren Wilson shot and killed Michael Brown, 18, on August 9th, 2014. The shooting of the unarmed teen sparked demonstrations that turned to looting. The protests have now gone over 100 days. A grand jury is currently meeting to decide to indict officer Wilson. Their decision could come any day.

Appeals Court Upholds Bans On Same-Sex Marriage For The First Time

Robert Barnes, Nov. 6, 2014, Washingtonpost.com

A federal appeals court panel upheld bans on same-sex marriage in four states Thursday, a break with other federal courts that makes it almost certain the Supreme Court must take up the issue of whether gay couples have a constitutional right to marry.

A panel of the U.S. Court of Appeals for the 6th Circuit in Cincinnati ruled 2 to 1 that although same-sex marriage across the nation is practically inevitable, in the words of U.S. Circuit Judge Jeffrey S. Sutton, it should be settled through the democratic process and not the judicial one.

Federalism Doesn’t Mean That States Can Do Whatever They Want

Ilya Shapiro, Oct. 27, 2014, Cato At Liberty

Cato and the Constitutional Accountability Center have filed another amicus brief in a marriage case, this one challenging Louisiana’s restriction of marriage licenses to opposite-sex couples and its non-recognition of out-of-state same-sex marriages. Filed in the U.S. Court of Appeals for the Fifth Circuit—where last month we filed in a case out of Texas—this is an appeal from the only ruling to uphold a state marriage law since the Supreme Court’s decision in United States v. Windsor struck down part of the Defense of Marriage Act. (A federal judge in Puerto Rico also recently upheld that commonwealth’s law.)

Our previous briefs, including in that Texas case and also regarding the marriage laws of Oklahoma, Utah, Virginia, Michigan, Tennessee, Kentucky, Indiana, and Wisconsin in the Tenth, Fourth, Sixth, and Seventh Circuits, respectively, focused on the original public meaning of the Fourteenth Amendment’s Equal Protection Clause and its guarantee of “equality under law” for all. Here, however, we focus on federalism, democracy, and why states shouldn’t automatically get judicial deference when they pass legislation.
